1. Scope
These Terms govern access to and use of the Caliu platform ("the Platform"), including the organizer portal website and the Caliu iOS app. By using the Platform, you agree to these Terms.
2. Service description
Caliu helps people discover and book local experiences. Organizers may publish events, manage bookings, and receive payouts through Stripe. End users may browse, book, and coordinate plans where features exist.
3. Registration & account security
- You must be at least 18 to register.
- You must keep credentials confidential and promptly notify misuse if suspected.
- You must provide accurate information and update it where necessary.
- Caliu may suspend accounts that violate these Terms or applicable law.
4. Organizer obligations
Organizers publishing on Caliu agree to:
Caliu may charge end users service fees consistent with disclosures at checkout.
- Provide truthful, complete, and non-deceptive event information.
- Comply with permits, licensing, taxation, venue rules, and safety requirements.
- Honor stated capacity constraints and lawful crowd management obligations.
- Complete identity and payout onboarding via Stripe Connect when applicable.
- Handle cancellations and refunds in accordance with clearly stated policies.
5. Payments & refunds
- Payments are processed by Stripe; Stripe terms also apply.
- User cancellations are governed by the organizer cancellation policy surfaced in-product.
- If an organizer cancels, users should receive refunds as applicable under policy and Stripe rules.
- Refunds may take several business days to appear depending on issuer and bank processing.
- Caliu is not liable for delays solely caused by banks or Stripe.
6. Acceptable use
You agree not to:
- Use Caliu unlawfully or to commit fraud.
- Post infringing, harassing, hateful, or misleading content.
- Attempt unauthorized access to accounts, APIs, databases, or systems.
- Abuse booking flows, inventories, integrations, or run unauthorized automation.
7. Intellectual property
Caliu retains rights to the Platform branding, UX, code, and related assets (subject to third-party libraries). Organizer-uploaded materials remain theirs, with a non-exclusive license to display them to operate Caliu.
8. Limitation of liability
To the fullest extent permitted by applicable law:
- Caliu is not responsible for third-party events beyond providing the marketplace tools.
- Caliu is not liable for indirect damages or consequential loss where excluded by law.
- Nothing excludes liability where it cannot legally be excluded (e.g., gross negligence/death/injury as applicable).
9. Changes to the service and terms
We may enhance, suspend, discontinue, or restrict features where reasonable. Material changes to these Terms will be communicated appropriately.
10. Governing law & jurisdiction
Spanish law applies, without prejudice to mandatory consumer protections. Depending on eligibility, venue rules may vary; organizers should seek counsel for contractual venue choices beyond consumer defaults.
